Procedural fairness

The increasingly global reach of business requires competition authorities to work together to develop fair procedures that parties can understand and rely on as a means of removing unnecessary uncertainty. At the Antitrust Division of the U.S. Department of Justice, we take that obligation seriously and premise our procedures on the belief that open and frequent dialogue between competition law enforcers and those under investigation helps ensure fairness to the parties and facilitates more effective enforcement. Our processes, of course, are not the only ones that are fair. Our traditions do, however, have the benefit of having been developed and tested over time, and it is possible they might be
