The motor vehicle sector continues to be the subject of regular litigation under the competition rules, even though the overall volume of cases brought has been marked by the drastic decrease in ordinary terminations since the entry into force of Regulation n° 1400/2002/EC [1]. in light of the obligation - specific to the sector - to give reasons for terminations of contracts of indefinite duration in order to be eligible for the block exemption. In light of the developments in competition law applicable to the motor vehicle sector, the peculiarities of the legal arrangements pertaining to it and the extent and specific nature of the case law dealing with it, one might ask if competition law for the sector has not now become an entirely separate legal area. Automobile distribution : Overview of some leading national cases in Europe
Le droit de la concurrence applicable au secteur automobile est très fortement influencé par le règlement d’exemption automobile. Tous les contrats de distribution et de service en vigueur dans ce secteur sont inspirés du règlement dont ils respectent les conditions afin de bénéficier de l’exemption. Faut-il en conclure que le droit de la concurrence applicable à l’automobile constitue une discipline à part ? La réponse est certainement positive dans le domaine du droit des ententes compte tenu de l’influence du règlement d’exemption. En revanche, dans les autres domaines du droit de la concurrence, le bilan de la jurisprudence récente rendue dans les différents Etats Membres montre que le droit commun s’applique sans difficulté à un secteur très concurrentiel.
