The new merger control guidelines of the French Competition Authority: What we need to know

Fayrouze Masmi-Dazi (Associate Lawyer, Frieh Associates) presented the subject of the conference, namely the draft merger control guidelines very recently submitted for public consultation, as well as the stakeholders.

Jérôme Vidal (Deputy Head of the Merger Department, Autorité de la concurrence) explained, as a preliminary remark, that the procedure initiated by the Autorité de la concurrence is part of its project to modernise and simplify merger control initiated at the end of 2017. In 2018, a number of stakeholders had been invited to comment on the existing guidelines and to submit suggestions as to what they thought the new guidelines should address. The Authority has taken into account, to the extent possible, the contributions received, in particular those of the Association of Competition Lawyers and Frieh Associés.
