The Commission is finalising the evaluation phase, in which it gathered evidence on the functioning of the Vertical Block Exemption Regulation (VBER) and the Vertical Guidelines. The main evidence is stakeholder feedback. This is in line with the general objective of the VBER, which is to facilitate (1) the enforcement work of the Commission and of the national competition authorities and (2) the self-assessment by companies of the compatibility of their vertical agreements with Article 101 TFEU. The stakeholder evidence was complemented by the enforcement practice of the past ten years at EU and national level. The Commission also published an evaluation support study in May 2020, which focused on market developments and consumer behaviour, as well as on specific areas of the rules (e.g. selective and exclusive distribution systems, resale price maintenance and parity clauses).
