SYNTHÈSE
Rafael Amaro, acting as moderator, introduced the discussion on the influence of the principles of EU law on Member States’ laws on compensation for damages caused by anticompetitive conducts, mentioning three recent judgments rendered by the CJEU (and pending cases) which all have revealed the degree of importance of those principles in the evolution of domestic laws : the Skanska decision ; the Cogeco decision and the Otis II decision. Those cases expand or supersede Directive 2014/104/UE and the findings support the enhancement of the effectiveness of claims for compensation. Also, those decisions materialise the increasing substitution of the CJEU for domestic judges in ongoing evolutions of the private enforcement of competition law.
