Access to facilities in the energy sector: An overview of EU and national case law

This study - which is not comprehensive - provides an overview of the main trends of regulatory intervention regarding access to facilities in the energy sector for the last 15 years. We have chosen a broadened meaning of the concept of “access” which includes direct access to electricity or gas physical infrastructures/networks as well as indirect access to those infrastructures/networks through production capacities. “Facilities” means facilities and associated resources owned by incumbents or those installed by new entrants. Regulatory intervention has taken the traditional forms of ex-ante and ex-post regulation. Ex-ante regulation refers to strong market regulation in order to prevent anticompetitive practices particularly from incumbent operators. It is a forward-looking approach
