The Spanish Competition Authority fines a manufacturer of office supplies for obstructing an inspection carried out at its head office (Grafoplas)

On March 1, 2011, the Spanish Competition Commission (Comisión Nacional de la Competencia, the “CNC”) fined GRAFOPLAS DEL NOROESTE, S.A. (“GRAFOPLAS”) €161,600 for obstructing an inspection carried out at its head office [1]. Background GRAFOPLAS is a prominent Spanish manufacturer of office supplies and stationery. To verify the existence, if any, of practices prohibited by article 1 of the Spanish Competition Act [2] (Ley de Defensa de la Competencia, the “LDC”) and article 101 TFEU, on October 27, 2010, officers of the CNC‘s Investigation Division (the “DI”) went to GRAFOPLAS‘ registered office in Culleredo (La Coruña) with an entry warrant, to carry out an inspection.
