The Latvian Supreme Court confirms Competition Authority’s decision of fining loyalty discounts practices in the food retailer sector (Latfood)

Latfood, previously being in a dominant position, loses a case The 22 March 2005 decision of the Department of Administrative Cases of the Supreme Court Senate closed the proceedings in respect of the 14 November 2001 decision of the Competition Council of the Republic of Latvia on imposing a penalty to AS Latfood (“Latfood”) for the abuse of dominant position (corresponds to 82 EC). The result of the proceedings was unfavourable to Latfood. Facts In 1999 Latfood, while being in a dominant position within the potato crisps and potato dough crisps sales market in Latvia, which it lost in January 2001, had entered into agreements with several retailers and wholesalers that restricted the sales of competitors' products within commercial networks by applying loyalty discounts to them.
