The Indian Ministry of Corporate Affairs proposes a significant change in respect of the search and seizure powers granted to the investigating office of Competition Authority

The Ministry of Corporate Affairs, Government of India which is the authority responsible for the functioning of the Competition Commission of India (CCI) has proposed a bill in the Lower House of Parliament of India on 10 December 2012 to amend the Competition Act, 2002 (Act). This proposal has been introduced to meet the present day needs of the law and the regulator after gaining reasonable amount of practical experience over the past four years since the law came into effect on 19 May 2009. The Competition (Amendment) Bill, 2012 (Bill) which is under consideration, proposes a significant change in respect of the search and seizure powers (‘dawn raids’) granted to the investigating office of CCI that is, the Director General (DG).
