A Czech Court confirms that phone recordings may be lawfully used as evidence in antitrust proceedings (Husky)

Introduction In April 2012 the Regional Court in Brno confirmed the decision of the Czech Office for Protection of Economic Competition (“Czech Competition Authority”) fining HUSKY CZ for resale price maintenance. Based on the findings of the Czech Competition Authority, HUSKY CZ set the maximum amount of discount from its recommended resale price provided by resellers. The Regional Court in Brno confirmed that the findings of anticompetitive conduct by the Czech Competition Authority may be lawfully based on phone recordings of conversations made without consent. Decision of the Czech Competition Authority The Czech Competition Authority found that HUSKY CZ agreed with its internet resellers on the minimum resale price which amounted to recommended resale price minus 8%.
