The Polish Competition Authority reduces severe penalty imposed by its President for obstructing inspections during a dawn raid (Polkomtel)

On 18 June 2014, the Polish Court for the Competition and Consumer Protection (“SOKiK”) changed the decision issued by the President of the Office of Competition and Consumer Protection (“NCA”) in which Polish mobile telecom operator (Polkomtel) was fined for non-cooperation in the course of a dawn raid. SOKiK found that NCA’s officials have made some procedural errors which violated Polkomtel’s fundamental rights. In result SOKiK has decided to reduce the penalty of EUR 33.000.000 (equivalent to ca. PLN 130.689.900) to EUR 1.000.000 (equivalent to ca. PLN 3.960.300).
