The Italian Council of State confirms the annulment of a €140 million fine imposed by the Competition Authority on steel companies, as they did not form a cartel in the reinforcing steel bar and electro-welded mesh markets (Reinforcing Steel Bars / Tondini per Cemento Armato)

On 21 January 2020, the Italian Council of State confirmed the annulment of a 140 million EUR fine imposed in 2017 by the Italian Competition Authority (“ICA”) to some of the main Italian steel companies. Indeed, the ICA – by Decision of 19 July 2017 (the “Decision”) issued in the proceedings I742 Reinforcing Steel Bars (the “Proceedings”) – ascertained the existence of an alleged collusion among Alfa Acciai S.p.A., Feralpi Siderurgica S.p.A., Ferriera Valsabbia S.p.A., Industrie Riunite Odolesi I.R.O. S.p.A., O.R.I. Martin - Acciaieria e Ferriera di Brescia S.p.A., Stefana S.p.A., Riva Acciaio S.p.A., Ferriere Nord S.p.A. and its parent company Fin.Fer. S.p.A.
