The EU General Court clarifies Commission’s duty of care and third parties’ right to be heard in merger control proceedings (NVV)

In a judgment of 7 May 2009, the Court of First Instance dismissed an appeal against the Commission’s decision unconditionally clearing the acquisition by Sovion of Hendrix Meat Group. The appellants (three interested third parties in the Commission’s Sovion/HMG proceedings) argued before the Court that the Commission’s decision was vitiated by substantive errors
