The Romanian Government adopts substantial reform of the Romanian competition law

On 5 August 2010, the Government Emergency Ordinance 459/2010 (hereinafter, the “GEO”) amending the Romanian Competition Law 21/1996 (hereinafter, the “Romanian Competition Law”) entered into force. The substantial amendments made to the Romanian Competition Law follow legal developments in the field of competition law both at a national and EU level. The most noteworthy changes relate to the notification system, de minimisagreements, abuses of dominant position, economic concentrations, sanctions for competition infringements and the setting of fines (in particular a new mitigating circumstance). The GEO abolishes the former notification system and provides that agreements which meet the conditions set out in Article 5(4) of the Romanian Competition Law (which mirrors Article 101(3)
