The Italian Council of State says that major ferry companies did not agree to increase fares for the Sardinia-Continental Italy maritime links (Sardinia Ferries Fares)

By a recent judgment made on 11 June 2013 in the Sardinia Ferries Fares case1, the Italian Council of State (CS) has rejected the appeal filed by the Italian Competition Authority (ICA) against the judgment of administrative court of first instance (Tar Lazio)2, which overturned the infringement decision previously made by the ICA. Indeed, the ICA had penalized four ferry companies - Moby, SNAV, Grandi Navi Veloci and Marinvest- for putting in place a price-fixing agreement in the shape of concerted practice affecting a number of maritime links between Sardinia and Continental Italy3. As already ruled by the Tar Lazio, also the CS did not consider the evidential facts and circumstances collected by the ICA as persuasive evidence of the allegedly price-fixing arrangement. The ICA
