The Luxembourg Competition Authority rejects an abuse of dominance complaint in the car insurance sector concerning alleged obligation to use a software application (OEIPA / Le Foyer Assurances)

On 5 September 2007, following quite a lengthy decision, The Competition Council (Conseil de la concurrence) (Council) rejected a complaint submitted to the Competition Inspectorate (Inspectorate) by a professional association of car damage experts (Ordre des experts indépendants professionnels en automobiles), OEIPA). OEIPA argued that the insurance company, Le Foyer Assurances S.A. (Le Foyer), abused its dominant position in the car insurance sector by imposing the use of a software application on car damage assessment services experts. The Informex system, marketed by the Belgian company Informex S.A., was established by 41 Belgian and 7 non-Belgian insurance companies (including Le Foyer) as well as 30 natural persons and legal entities active in the field of car damage
