The Czech Supreme Administrative Court admits a legal exemption for recommended price lists issued by a professional association (Chamber of Authorized Engineers and Technicians)

On 24 September 2007, the Czech Supreme Administrative Court quashed a previous decision of the Regional Court in Brno which confirmed decisions of the Czech Office for the Protection of Competition (the “Office”) imposing a penalty of CZK 500,000 upon the Czech Chamber of Authorized Engineers and Technicians Active in Construction (“Chamber of Authorized Engineers”). The penalty was imposed for the alleged breach of the Act n° 143/2001 Coll., On Protection of Competition, as amended (the “Czech 2001 Competition Act”) by issuing a list of recommended prices to be applied by members of the Chamber of Authorized Engineers.
