On 6 October 2022, the Court of Appeal of Paris (“the Court”) granted a partial reformation of the decision of the French Competition Authority (“FCA”) of 16 March 2020 concerning practices related to the distribution of certain Apple products (the “FCA Decision”) and reduced by twothirds the original fine of € 1.1 billion imposed on Apple to € 372 million (see also VBB on Competition Law, Volume 2020, No. 3). The Court also reduced the fines imposed on the two wholesalers of Apple products, Ingram and Tech Data, from € 76.1 million to € 19.5 million in the case of Ingram and from € 62.9 million to € 24.9 million in the case of Tech Data.
