On 24 October 2018, the French competition authority (the “FCA”) fined Stihl, a German manufacturer of outdoor power tools, € 7 million for, in effect, prohibiting online sales of chainsaws, brush cutters, pole saws and electric pruners. Stihl operated a selective distribution system, under which online sales were in principle permitted, but only where: (i) the products were handed over in-person to the customer (either at the distributor’s premises or at the customer’s home); and (ii) the sale was not made over a third party platform. The FCA did not take issue with the use of selective distribution
