I. Introduction On 31 October 2014, the Osaka High Court (“Court”) found that Shintetsu engaged in an unfair trade practice in violation of the AMA by physically preventing the Drivers from seeking and acquiring customers at taxicab stands outside two Kobe Electric Railway Co., Ltd’s stations (“Stations”). Shintetsu is a subsidiary of Kobe Electric Railway Co., Ltd. The Court issued an injunction preventing Shintetsu from such acts and also awarded nominal damages for loss of operating profits of the Drivers. II. Competition between parties The Court found that there are considerable numbers of potential customers outside the Stations including those who get off the train there and that the taxicab stands outside the Stations were the only areas where taxis could wait and pick up
