Introduction The Office of Thai Trade Competition Commission in Thailand (‘OTCC’) recently discussed proposed changes to Thailand’s Trade Competition Act 1999 (the ‘Act’) during a public hearing held on 28 October 2014. This is the first substantial review of the Act since its enactment in 1999. The Act has to date been minimally enforced, partly due to the absence of implementing regulations. In addition to providing additional power and authority to the OTCC, significant changes include extending the scope of the Act to cover certain state enterprises and affiliated companies of business operators, specifying the criteria for triggering the application of the merger control provisions and amending the penalties for violating the substantive prohibitions in the Act.
