Relevance of the Opinion The Opinion touches upon the disclosure through the Regulation 1049/2001 ("Transparency Regulation") of cartel-related-documents held by the Commission. First, it addresses how the Commission should handle these requests, in particular, it tackles the harmonious interpretations of the Transparency Regulation and the potential existence of a general presumption against disclosure. Second, it assesses the scope of the main exceptions included in the Transparency Regulations to refuse access: the purpose of investigations and the commercial interests exceptions.
