The EU Court of Justice validates exclusive rights for broadcasting of sports events provided they do not grant absolute territorial exclusivity (Football Association Premier League)

The Football Association Premier League (FAPL), holder of the television broadcasting rights for the Premier League, the leading professional football league competition for football clubs in England, grants exclusive licences in respect of those broadcasting rights to one TV channel per country. To protect the territorial exclusivity granted, the broadcaster must undertake to encrypt the signal and transmit it via satellite only to subscribers in its designated territory.
