The EU Court of justice rules on predatory pricing in the form of price squeeze (Deutsche Telekom)

The case discussed in this brief has lasted several years as it gave rise to a decision adopted by the European Commission and a judgment issued by the general Court before ending up, on appeal, before the European Court of justice. As other judgments, this ruling raises the question to what extent, when they dominate a market, firms still have the right to choose freely the prices at which they want to sell their products or services. The ruling also addresses the right, for the European Commission, to intervene directly, on the basis of the rules of competition, in markets where secondary legislation has been adopted and where measures are taken by national regulatory authorities in application of that European legislation as implemented in the national legal order.
