The French Competition Authority accepts commitments from the incumbent operator in the sector of engineering, consultancy and certification of telecommunication facilities in a case of alleged abuse of dominant position (Solutel / France Télécom)

In a decision of 7 October 2008, the French Competition Council (the "Council") accepted commitments submitted by France Telecom regarding an alleged abuse of its dominant position in the sector of engineering, consultancy and certification of private telecommunications facilities pursuant to Article L. 464-2 (III) of the French Commercial Code (provision equivalent to Article 9 of EC Regulation n° 1/2003 [1]. This decision follows a complaint filed before the Council by Solutel in 2006. Background The French Code for Urban Planning states that promoters or property developers can be required to create, at their expense, the necessary facilities for the connection of their properties or estate to gas, electricity and telecommunication networks.
