On 2 October 2007, the Paris Court of Appeals (the "Court of Appeals") upheld a decision issued by the Conseil de la concurrence (the "Competition Council") in Decision n° 06-D-15 dated 14 June 2006 relating to practices implemented in the railway laying and maintenance sector. In this decision, the Competition Council fined operators active in this sector, which constitutes a specific market [1], for anticompetitive practices in tendering procedures. An interesting point in this case is that the Court of Appeals nonetheless decided to reduce the fines in view of the facts considered by the French Competition Council and the current financial situation of the company concerned.
