The EU Commission publishes a Communication on a competition policy which would support the transition to a sustainable, digital, and resilient European economy

On 18 November 2021, the European Commission (“Commission”) published a communication on a competition policy fit for new challenges (“Communication”). There has been a significant push toward a more European Union-centred industrial policy which would support the transition to a sustainable, digital, and resilient European economy. This has raised questions about how a future EU competition policy and enforcement can be better aligned with the European Union’s overarching policy goals, in particular whether competition law enforcement should become more flexible to better support industrial policy goals. In the Communication, the Commission declares that it has been conducting a policy review “of unprecedented scope and ambition”. In the end, however, the Communication identifies
