In a ruling dated 10 November 2009, the Paris Court of Appeal overturned a decision of the national competition authority (the "Authority") for excessive duration of the proceedings for the first time. This decision of the Authority related to alleged anticompetitive practices by several companies active in the luxury perfume sector. Background On 5 December 2006, the Authority imposed fines on thirteen manufacturers active in the luxury perfume sector and cosmetic brands and three national distribution chains for anticompetitive vertical agreements between 1997 and 2000 . The total of the fines amounted to 46.2 million Euros.
