The Chinese State Administration for Market Regulation solicits public opinions on the Draft Regulation on Fair Competition Review
On 12 May 2023, the State Administration for Market Regulation (SAMR), China's central competition authority, released the Regulation on Fair Competition Review (Draft for Public Opinions Solicitation) (Draft) [1]. The final and official version of the Draft, Regulation on Fair Competition Review (FCR Regulation), will be signed by the Premier and promulgated by the State Council. This is in response to the amendment to the Anti-Monopoly Law of the PRC (AML) in 2022. [2]
This administrative regulation will be specifically formulated for the fair competition review system, with a stronger binding force and higher legal hierarchy, only lower than the AML. [3] It will have a positive impact on handling the relationship between the government and the market, strengthening competition
