The Brussels Court of Appeal asks the EU Commission to provide advice and information regarding the tariffs for concerts and music festivals of a copyright collecting society (SABAM)

On 10 May 2019, by interim judgment, the Brussels Court of Appeal asked the European Commission to provide advice and information regarding the tariffs for concerts and music festivals of SABAM – the Belgian copyright collecting society – in light of the prohibition to abuse a dominant position pursuant to Article 102 Treaty on the Functioning of the European Union (“TFEU”). The Brussels Court of Appeal’s interim judgment follows the appeal by SABAM against the cease and desist order by the Brussels Commercial Court of 12 April 2018 in which the Brussels Commercial Court sided with t he claimants (several festivals and the federation of Flemish music festivals).
