The number-one Polish telecom operator – former State owned monopoly - was suspected of a violation of Article 8 of the Polish law on competition and consumer protection and of Article 102 of the Treaty on the Functioning of the European Union (TFEU). At the end of the procedure the Polish national competition authority (NCA) found that although the companyTelekomunikacja Polska S.A. (TPSA) was in a dominant position on the market, its conduct did not constitute an abuse of that position. The NCA ruled that Telekomunikacja Polska S.A. (TPSA) had not violated Article 8 of the Polish law on competition and consumer protection and, with regard to Article 102 TFEU, brought the procedure to an end on the ground that it was devoid of purpose.
