The Brussels Court of Appeal requests the Supreme Court to rule on use of languages in competition proceedings

In a judgment of 3 May 2011, the Brussels Court of Appeal has requested the Supreme Court (Hof van Cassatie/Cour de Cassation) to give a preliminary ruling on questions relating to the use of languages in proceedings before the College of Competition Prosecutors. The case concerns a complaint lodged before the Belgian Competition Council by the KPN Group and Mobistar against Belgacom for an alleged abuse of a dominant position on the market for broadband access. The complaint was drafted in French. During the investigation before the College of Competition Prosecutors, Belgacom requested to be able to defend itself in Dutch. The College of
