The UK Competition Commission clears an entertainment industry merger for the second time without remedies following appeal to the Competition Appeal Tribunal (Ticketmaster / Live Nation)

On May 7th 2010, the UK Competition Commission (CC) cleared unconditionally the completed merger between Ticketmaster Entertainment, Inc (Ticketmaster) and Live Nation, Inc (Live Nation). The case had previously been cleared by the CC in December 2009, but following a successful appeal by a third party-CTS Eventim (CTS)-it was remitted to the CC for reconsideration. The case was originally referred to the CC by the UK Office of Fair Trading (OFT) in June 2009 following a Phase I investigation. The OFT's primary reason for referral was that the merger would lead to a loss of potential competition in the supply of tickets for live music events. Prior to the merger with Ticketmaster, Live Nation had entered into an agreement with another ticket agent, CTS. The OFT's conclusion was that,
