The Italian Competition Authority opens a compliance procedure on the implementation of remedies regarding a merger in the banking sector (Banca Intesa / SanPaolo IMI)

By a decision taken on 14 May 2009, the Italian Competition Authority or ICA has opened an investigation into whether the parties to the BancaIntesa/San Paolo IMI concentration fulfilled the remedies imposed with the conditional authorization of the transaction [1] . The ICA conditional authorization of the BancaIntesa/San Paolo IMI merger BancaIntesa/San Paolo IMI is one of the first banking mergers to be reviewed by the ICA since the Act 262/2005 gives it full responsibility over the banking sector. The merger, resulting in the acquisition of San Paolo IMI by BancaIntesa, was found to be likely to create or strengthen a dominant position in many markets for banking and financial services.
