The Versailles Court of Appeal issues a decision regarding the selection of distributors of new vehicles in a qualitative and quantitative selective distribution system (Sodac / BMW)

Legal disputes often arise relative to the selection of distributors of new vehicles in distribution systems that are both qualitative and quantitative in the various Member States of the EU. An analysis of the decisions rendered reflects the significant difficulties, after entry into force of Regulation n° 1400/2002 [1] , in getting to grips with qualitative and quantitative selective distribution for new vehicle distribution networks chosen by virtually all car brands in Europe. In reality, the courts have found it hard to accept the existence of distribution networks based on quantitative criteria pre-defined according to the provisions of the motor vehicle regulation which are not reviewable as to their substance and allow suppliers to simply refuse to readmit former dealers when
