The UK Competition Appeal Tribunal dismisses the appeal against Ofcom’s non-infringement decision regarding a long term contract on the supply of television access services (Channel 4 / BBC Broadcast)

On 20 May 2008 the Competition Appeal Tribunal dismissed the appeal by Independent Media Support Group (IMS) against the Office of Communication's (Ofcom) non-infringement decision regarding a long-term exclusive supply agreement between BBC Broadcast (BBCB) and Channel 4. This exclusive agreement covered the supply of television access services, i.e. subtitling, signing and audio description services for TV broadcasts. The investigation was triggered by a complaint by Independent Media Support Group plc (IMS), a competing provider of television access services. In May 2007 Ofcom had decided that the exclusivity and duration of that agreement had not infringed the Chapter I prohibition or the Chapter II prohibition of the Competition Act 1998 or the equivalent provisions of Article 81
