The Polish Competition Authority prohibits an entrepreneur in dominant position to discriminate between national and foreign entrepreneurs (Regional Board of Management of State Forests in Wroclaw)

In July 2003, the President of the Office for Competition and Consumer Protection (hereafter, OCCP President or President of the Office) received a complaint from Drebszok-Drewpol (hereafter, “DD”) a Polish company having as its major activity exportation of lumber bought from the Regional Board of Management of State Forests in Wroclaw (hereafter, Regional Board). The latter one is an organizational unit of State Forests, which has no legal personality, but is empowered to administer the property of the State Treasury, in particular to sell lumber. DD invoked in its complaint that the Regional Board applied different conditions to its lumber selling contracts with Polish and foreign contractors. In contracts with national entrepreneurs, the quantity and quality of lumber was examined
