The Cyprus Competition Authority imposes a fine of €237,181.76 on an undertaking for abusing its dominant position (MTN)
Introduction
On 29 March 2019 the Cyprus Commission for the Protection of Competition (“CPC”) issued a decision imposing a fine of €237,181.76 on MTN Cyprus Limited (“MTN”) for a violation of Section 6(1)(b) of the Protection of Competition Law (Law 13(I)/2008), as amended (“Law”). The said violation was founded on MTN’s decision to impose call barring to its mobile telephony contract plan subscribers regarding premium rate services (e.g., premium Interactive Voice Response, premium messages). As a result, the supply of such services was restrained to the detriment of consumers, from 2005 until the beginning of July 2015.
The decision of the CPC was issued after a complaint filed by Golden Telemedia Limited (“Golden Telemedia”) on 15 September 2014.
