An Italian administrative court applies the doctrine of essential facilities to a theatre (Teatro della Provvidenza)

On appeal the Regional Administrative Court for Lazio (Tar Lazio) has annulled the non infringement decision of the Italian Competition Authority (ICA) regarding the refusal of the owner of a theatre to grant a theatre troupe access to it [1]. The Tar Lazio applied the doctrine of essential facilities to the theatre and hold that by refusing access the owner abused its dominant position. The facts of the case In 2009 the applicant, a theatre troupe (Associazione Culturale Compagnia Michele Murino Cilento Arte, the Association) applied to the Diocesi of Vallo della Lucania (the Diocese) for access to the theatre, Teatro della Provvidenza, the Diocese owned in the town of Vallo della Lucania. The Diocese never replied to the Association, which then filed a complaint with the ICA. The
