In an opinion issued on June 14, 2018, the United States Supreme Court addressed the effect U.S. courts should give to a foreign government’s interpretation of its own laws. In Animal Science Products v. Hebei Welcome Pharmaceutical Co. Ltd., the Supreme Court revived the possibility of a US$147 million price-fixing judgment against Chinese vitamin C makers, reversing the Second Circuit’s 2016 decision vacating the judgment. In a unanimous opinion written by Justice Ginsburg, the Supreme Court ruled that federal courts determining foreign law under the Federal Rules of Civil Procedure should accord “respectful consideration” to a foreign government’s interpretation of its own laws, but are not bound by the foreign government’s interpretation.
