The Moldovan Competition Authority prosecutes a grain storage operator for exploitative abuse of dominance in the form of discriminatory tariffs (Cereale Cupcini)

On 14 June 2018, the Competition Council of the Republic of Moldova (CC) [1] has found that grain storage operator Cereale Cupcini SA has abused its dominant position by imposing excessive and discriminatory tariffs for loading/unloading services at its storage facilities. [2] The CC’ investigation [3] has been prompted by a complained submitted by the Material Reserves Agency (ARM), [4] a central administrative authority that operates under the Ministry of Internal Affairs, [5] implements state policies in the field of state reserves, established to contribute to the country’s defense, protection of population and economy in exceptional situations. In 2017, the Government has ordered ARM to release from the state reserves 30,420 tons of wheat in order to refresh the reserves. [6] The
