The Luxembourg Competition Authority allows a price fixing agreement between supermarkets as it could enhance competition (Epiceries du Luxembourg)

In June 2018, the Luxembourg Competition Council published a decision regarding forms of cooperation between competitors involving price fixing, one of the most manifest and serious restrictions of competition. The decision concerned a group of supermarkets who decided to market certain products together and agreed on the prices they would offer for those products. This case is interesting because the Council considered that there only existed an unlawful price fixing arrangement as regards the two supermarkets which were in a competitive relationship. The other supermarkets were not present on the same geographic market and therefore where not competitors, which meant that their price fixing for certain products were not viewed as infringing competition law.
