The Italian Competition Authority fines a producer for abuse of its dominant position in the plant health products market (Sapec Agro / Bayer-Helm)

Introduction By the Sapec Agro/Bayer-Helm decision the Italian Competition Authority has fined € 5.124.359,00 Bayer Cropscience AG (BCS) and its Italian subsidiary Bayer Cropscience Srl for abuse of dominant position in the market for the production and commercialization of fosetyl-based fungicides [1]. The decision is based on the application of the doctrine of essential facilities as the studies in possession of BCS on the effects of fosetyl were considered as essential facilities. In fact, under the regulatory regime in force, access to such studies was an indispensable condition for the award of market authorization for fosetyl-based products. The facts of the case In February 2010 the ICA opened an Article 102 TFEU investigation against BCS following the receipt of a complaint
