The Turkish Competition Authority rules that the block exemption on vertical agreements applies to a vertical agreement containing hard-core restraints (Sinan Erdoðan / Lido Su)

Sinan Erdoðan (the “Distributor”) applied on 23 May 2008 to the Turkish Competition Board (the “Board”) alleging that the distribution agreement (the “Distribution Agreement”) entered into with Lido Su and Gýda San. Tic. A.Þ. (“Lido Su”) in October 2006 regarding the resale of spring water in polycarbonate carboys was in breach of the Competition Law (the “Law”). The Board noted that since the market share of Lido Su in the spring water in polycarbonate carboys market is less than 40% the Distribution Agreement falls within the scope of the Block Exemption Communiqué on
