The Paris Court of Appeal receives observations from the EU Commission which constitutes the very first submission to a national court since the adoption of Reg. n° 1/2003 (Garage Gremeau / Daimler Chrysler)

Background According to Article 15(3) of Council Regulation (EC) n° 1/2003, of 16 December 2002, on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty (OJEC L 1, 4 January 2003, pp. 1-25), the European Commission (the “Commission”) may submit observations on issues relating to the application of Articles 81 or 82 EC to a national court which is called upon to apply those provisions. Whilst written observations may be submitted on the Commission's own initiative, oral observations can only be presented with the authorisation of the national court concerned. The possibility for the Commission to submit observations before a national court is restricted to cases where the coherent application of Articles 81 or 82 EC so requires. Commission Notice
