The French Supreme Court recalls the conditions for the demonstration of collective dominance (Lafarge Ciments / Vicat)

On 9 July 2009, the French Supreme Court (the "Supreme Court") partially quashed a decision of the Paris Court of Appeal ruling that two cement operators (Lafarge and Vicat) had abused their collective dominant position on the market for the supply and distribution of cement in Corsica. This ruling is an opportunity to recall the conditions for the demonstration of a collective dominant position. Background In its Decision 07-D-08 dated 12 March 2007, the French Competition Authority (the "Authority") had considered that two agreements between Lafarge and Vicat and their main distributors in Corsica, which effectively attributed the whole market for the supply of cement in Corsica to these operators, foreclosed the Corsican market to foreign competitors.
