On 14 December 2010, the European Commission (the «Commission«) published a set of documents dealing with cooperation between competitors, comprised of guidelines on the applicability of Article 101 of the Treaty on the Functioning of the European Union [1] («TFEU«) (the «EU Guidelines«) [2] and two new block exemption regulations, one applicable to research and development agreements and the other applicable to specialization agreements [3]. With two significant exceptions, one of which is the focus of this article [4], the boundaries of this 2010 package are largely drawn upon those set by its 2000 predecessor [5]. The focus of this article is the inclusion of a new chapter on information exchange, which is the Commission’s first attempt at guidance of general application on this topic
