The Spanish Competition Authority publishes a report on intellectual property rights’ collective management

On 19 January 2010, the Spanish Competition Commission (hereinafter, the “NCC”) published a report on the collective management of intellectual property (IP) rights in Spain (the “Report”). The aim of the Report is to analyze the structure of the market of the management of IP rights [1] , with a particular focus on: (i) the calculation of the establishment of the fees charged by the collecting societies (and whether they are unfair and/or discriminatory, as well as on (ii) the existence of entry barriers in the market (and how this is affecting the existence of competition in the sector). In its analysis the NCC has considered both the IP rights' regulatory framework and the regulation and conduct of collecting societies in Spain.
