In a ruling dated 19 January 2010, the Paris Court of Appeal (the "Court") substantially reduced the highest fines ever imposed by the French Competition Authority (the "Authority") in the steel cartel case, from 575.4 million Euros to 74.1 million Euros. This judgement raises the question of the calculation of fines in the case of anticompetitive practices. Background On 16 December 2008, the Authority condemned eleven companies active in the steel sector and the main industry association, the Fédération Française de Distribution des Métaux (FFDM ), to pay a total fine of 575.4 millions Euros for setting up a hardcore cartel between 1999 and 2004, in breach of Article 81 EC and Article L. 420-1 of the French Commercial Code (equivalent to Article 81 EC).
