The Cypriot Competition Commission fines telecommunications incumbent for refusing access to the essential facility (Cyprus Telecommunications Authority)

In a published decision of 12 January 2010, the Cypriot Commission for the Protection of Competition (“CPC”) concluded that the Cyprus Telecommunications Authority (“CYTA”) abused its dominant position in the premium SMS (short messaging services of added value) market in breach of the applicable provision of Cypriot law. Thunderworx Ltd, a telecom services provider, had filed an initial complaint with the CPC in which it accused CYTA of infringing
